OCR Isn't the Only Security Enforcement Agency to Worry About

After any major health data breach, healthcare providers and business associates can expect an investigation by the Department of Health and Human Services' Office for Civil Rights. But some alleged security incidents also bring scrutiny from the Federal Trade Commission. This session will offer a case study on the FTC's investigation of LabMD, an Atlanta-based cancer screening lab. FTC's proposed enforcement action against LabMD in 2013 has led to the shuttering of the lab, an intense debate about the FTC's role in security investigations and a protracted legal fight. Michael Daugherty, founder, president and CEO of LabMD and the author of the book "The Devil Inside the Beltway," will share his real-world experiences with an FTC investigation.
